Sales Disclosure Form Instructions

The Department of Local Government Finance (“Department”) has revised the Sales Disclosure Form (State Form 46021), effective January 1, 2021. The revisions are the culmination of nearly two (2) years of work by an ad hoc committee comprised of representatives from the Department, the Indiana County Assessor’s Association, the Indiana Land Title Association, the Indiana Realtor’s Association, the Indiana State Bar Association, and a property tax assessment vendor.

As part of the revision process, the Department also updated 50 IAC 26 (LSA No. 19-365), with the final rule adopted on July 2, 2020, and the revised rule containing the updated Sales Disclosure Form file specifications becoming effective on January 1, 2021.

The Sales Disclosure Form (“SDF”) remains a tool primarily intended to capture sales data so that assessors can develop trending factors used in the annual adjustment process. The revisions are intended to help obtain better and more complete information. One of the more significant revisions is the creation of a separate addendum for Agricultural or Residential property, as well as an addendum for Commercial or Industrial property. The intent in creating a separate addendum for the property classes is to streamline the filing process as well as assisting the assessing official to identify the property being conveyed.

The Assessor’s Office is currently open to the public.  Any documents which need to be submitted to the Assessor’s Office may be deposited into the drop boxes located at the Marshall County Building, mailed to our office, brought into our office, or emailed directly to us using the email link on this page. Our office is staffed with individuals who are ready to provide assistance and guidance to the fullest extent of our capability. A substantial amount of information regarding your property assessment can be obtained by reviewing the available information and documents within our Beacon GIS system. The County Assessor is responsible for accurately and uniformly determining the market value-in-use of every property in Marshall County as of January 1 of the current year. Assessing officials must follow the rules of the Department of Local Government and Finance (DLGF) in all assessment or reassessment of real property practices. These processes are intended to distribute the property tax burden in a uniform and equitable manner.  Mass appraisal is used as a process of valuing a group of properties as of a given date, using valid market sale prices, standard methods, employing common data, and allowing for statistical testing.  We welcome any questions and/or concerns you may have with the methods used to determine the value-in-use of your property.

This is achieved by using three approaches to value
  1. Cost
  2. Income
  3. Sales Comparison

The State requires annual adjustments of assessments to reflect changes in the market. Pursuant to IC 6-1.1-4-4, the Cyclical Reassessment has commenced. Every year, we are required to review approximately 25% of the parcels in Marshall County.

In general, the County Assessor performs the following duties

  • Establishes Boundaries for Neighborhoods within their Townships
  • Utilizes Recent Sales of Land to Establish Base Market Rates and Values
  • Determines and Certifies Mobile Home Assessments to County Auditor
  • Processes and Certifies Personal Property Assessments

The County Assessor is a statutory officer who is elected for a term of four years and may be elected without a term limit. This official functions under the direction of the Department of Local Government Finance and is required to have an Indiana Level III Assessor/Appraiser Certification. 

You are encouraged to contact the Assessor’s Office if you have any questions or concerns regarding your assessments. The staff will be happy to explain the various processes used in the valuation of property.

Auditor's Office

The County Auditor is responsible for various areas within county government. The auditor serves as a secretary to the board of County Commissioners and the County Council.

The auditor has responsibility for keeping accounts and issuing checks for the county. As a result, the board of commissioners, the council and other officials often look to the auditor for day-to-day operational assistance, information and advice.

In keeping accounts and issuing warrants, the auditor must develop financial analysis and cash flow projections and assist with budget preparations. The auditor is the principal financial officer in county government and is defined under IC 36-2-9-2 as the fiscal officer of the county.

The county auditor must also prepare and file an annual financial report with the State Board of Accounts.

The auditor is directly responsible for preparing tax duplicates that show the value of property and taxes assessed against each taxpayer.

As a part of the tax function, the auditor must also prepare plats that show the ownership and assessed valuation of each parcel in each township in the county. The plats must contain information prescribed by the Department of Local Government Finance and must be kept current.

The Marshall County Building Commission has been established by local ordinance in compliance with state code. It grants counties the right to create an agency to assure that construction and modification of all structures within the unincorporated areas meet the minimum standards as established by the State of Indiana. The Department administers and enforces building, heating, ventilation, air conditioning, electrical, and plumbing standards for the protection of life, health, environment, public safety, and the conservation of energy in the design and construction of buildings and structures.

This Department also serves as the building permit and inspection agency for the Towns of Argos, Bourbon, Bremen, Culver and LaPaz to ensure compliance with all applicable building laws. The City of Plymouth maintains its own Building Inspection Department and can be contacted at (574)936-2824.

Clerk's Office

Clerk of Court Seal

The office of the Clerk of Circuit Court is established by the Indiana State Constitution to serve as the record keeper for the constitutionally created Circuit Court.  

The clerk is elected by the residents of Marshall County and is limited to serving two (2) consecutive four (4) year terms.

The Clerk’s office accepts filings of commencement of actions in litigation, enters judgments and orders for four Courts:  

  1. Circuit Court
  2. Superior Court I
  3. Superior Court II
  4. Superior lll

Court filings include Civil, Criminal, Probate, Family, Mental Health, Juvenile and Traffic.

The Clerk’s office responsibilities include collection and disbursement of court costs, fines, judgments, restitution, probation fees, community correction fees and miscellaneous fees. The Clerk also collects and disburses child support payments, issues marriage licenses, makes certified copies of records and is an acceptance agency for passports.

The Clerk is appointed by statute to serve as the Secretary to the County Election Board. The Clerk administers all elections held within the county and maintains all county voter registrations. Marshall County is a Vote Center County and absentee voting is available in the Clerk’s office.

In general, the Clerk is required to perform all official duties imposed by statue or by lawful authority of the court.

Coroner's Office

The Coroner and his staff are responsible for determining the case and manner of death when a person dies from violence, by casualty, and suspicious or an unnatural manner.

We are responsible for certification of death certificates and many more applicable reports during a death investigation. The law which governs this office is Indiana Code: 32-2-14. The Coroner’s office works in conjunction with Law Enforcement, as they are present at every death scene.

Most importantly, we work closely with the families of a decedent during a death investigation. We become a “gate keeper” per say, as it is our responsibility to provide answers that may be asked, and help families coordinate with funeral homes, the Health Department and in some cases, notification of other family members and agencies.

The principles and values that I and my deputies adhere to are very high. Every death deserves an investigation and we treat the families and the deceased with the dignity and respect that they deserve.

County Council

Term

The Marshall County Council is comprised of seven members, four elected from districts and three elected at-large. Each serve four year terms.

Roles & Responsibilities

They are responsible for setting salaries, the annual budget, and special spending. The council also has limited authority to impose local taxes, usually in the form of an income tax that is subject to state level approval, excise taxes, or service taxes, like those on dining or lodging.

County Commissioners

Term

The Marshall County Commissioners are comprised of three members, each elected countywide. Each serve four-year terms.

Roles & Responsibilities

The Commissioners are the executive body of the county and are responsible for county buildings, lands and property; audits and authorizes claims against the county; receives bids and authorizes contracts; supervising many County departments; oversee construction and maintenance of roads and bridges as well as exercise many of the legislative powers and duties of the county.  

Meeting Schedule

The Board meets on the first Monday, at 8:30 a.m. and the third Monday, at 9:30 a.m. (the precise starting time of the this meeting may vary, depending on the length of the Drainage Board meeting immediately preceding), every month in the Commissioners Room 203. Meeting dates are subject to change because of scheduled holidays or per the Commissioners’ schedules.

        Highway Department

        The Marshall County Highway Department is responsible for maintaining 911 miles of county roads, and 114 bridges.

        You will often see an orange truck patching holes on the county highways, grading a gravel road, or plowing snow in the winter.

        As you’re driving on the county roads, please take notice of any orange trucks or road construction workers who may be out of their vehicles. While they’re making sure that you have good roads to drive on, help them have a safe road to work on by paying close attention while driving.

        Our contribution to the community is more than what you can immediately see. In addition to maintaining roads, our employees also go the extra mile to make the county more aesthetically pleasing by picking up trash, clearing away dead animals, trimming trees and mowing the right of ways, and keeping the county culverts cleaned.

        Planning Department

        GENERAL INFORMATION

        The Planning Department works to guide the growth and development of the County in accordance with the Marshall County Comprehensive Plan and for the following purposes.

        1.  To secure adequate light, air, and convenience of access; and safety from fire, flood and other dangers.

        2.  To promote the public health, safety, comfort, convenience, morals and general welfare.

        3.  To plan for the future development of the County to the end.

        CURRENT PLANNING

        Current Planning involves administering the Marshall County Zoning Ordinance, Subdivision Ordinance and related regulations.  This includes processing applications for Improvement Location Permits, subdivisions, variances and other land use applications.  Staff also assists the public with questions related to the zoning code such as zoning classifications, permitted land uses and development standards.

        LONG RANGE PLANNING

        The Marshall County Comprehensive Plan is a document which guides the County's growth and it is used frequently.  The Marshall County Planning Department is responsible for development of the Comprehensive Plan as well as other long-term planning projects and studies.

        Planning staff is responsible for a variety of technical services including address management, data collection, and zoning verification.

        Mission Statement

        The Mission of Probation is to provide necessary services to the offender toward reducing criminal/delinquent behavior, while balancing the needs and insuring the safety of the community. Probation is a profession that requires fundamental knowledge of the law, sentencing alternatives, human services and community protection.

        Probation Vision

        • To assure victims of criminal activity will receive restitution and their needs and concerns are addressed in all matters.

        • To reduce recidivism of offenders through a full range of brokered services that encourages and facilitates law-abiding behavior.

        • To hold offenders accountable for their behavior and intervene as necessary.

        • To promote staff safety through education and ongoing training.

        • To promote continuing professional education of probation staff members in order to enhance services to the court, victims, the community, and offenders.

        Keys to Success

        Over 85% of Marshall County Probationers get released from probation successfully. In order to achieve this success, there are basic requirements to which you must adhere. They are:

        1. You must not commit any further criminal acts.

        2. You must be employed full-time or be a fulltime student.

        3. You must refrain from illegal drug use.

        4. You must abide by and complete any and all terms of probation the Court has ordered including paying you financial obligations to the probation department, court, restitution, and treatment agencies.

        5. You must not leave the state of Indiana with out permission.

        6. You must maintain communication and remain in contact with your probation officer during your probation period.

        Prosecutor's Office

        Roles and ResponsibilitiesE. Nelson Chipman, Jr.

        The primary function of the Marshall County Prosecutor’s Office is to represent the State of Indiana and prosecute individuals charged with the commission of a crime that occurred in Marshall County, Indiana.  Law enforcement agencies throughout Marshall County investigate crimes and submit the results of the investigation to our office for review. These agencies include the police departments of Plymouth, Bremen, Bourbon, Culver, and Argos, the Marshall County Sheriff’s Department, the Indiana Department of Natural Resources, and the Indiana State Police. On occasion, other state and federal agencies submit the results of investigations to our office as well.

        If sufficient evidence exists to prove that an identified suspect committed a crime, my office files a criminal information in one of our three courts charging the individual and then prosecutes the case to a conclusion. If a defendant is convicted of committing the crime, he or she will be sentenced by a judge.

        Other Services

        Another important function of the Prosecutor’s Office is to assist custodial parents with child support collection and related matters. Additionally, my office assists crime victims through consultation and referral to service agencies to help ameliorate the devastating effects of victimization. We view ourselves as a team in this office consisting of deputy prosecutors, paralegals, child support caseworkers, a victim advocate, and essential support staff, dedicated to accomplish a common goal of making Marshall County a better and safer place to live, work, and raise a family; one case at a time.

        Recorder's Office

        The elective office of County Recorder was the first local office created by the Constitution of the State of Indiana in 1816.

        Roles and Responsibilities

        It is the primary duty of county recorders to record instruments submitted for recording and maintain those records for perpetuity. Documents for statistical record keeping purposes fall into four categories:

        1. Deeds and other Conveyances
        2. Mortgages and other Liens and their Releases
        3. Miscellaneous Documents
        4. Uniform Commercial Code Documents 

        Marshall County records are all digitized with indexing complete back to 1960.

        Marshall County Recorder’s Office mission is to accurately record and preserve the history of our wonderful county. We desire to do that with the latest technology, the professionalism and the courtesy that our customers deserve.

        Per IC Code 36-2-7.5 this statement must appear on any document executed in the state of Indiana:

        In order to record a properly prepared deed or conveyance, it must first be submitted to the Marshall County Assessor’s Office and the Marshall County Auditor’s Office.  The Assessor’s Office may require a waiver/sales disclosure form to be filed with the document when recording.

         

        It is the preparer’s responsibility to comply with State Law.
